
The justice of the Democratic Republic of the Congo has rendered a firm decision in a case of attempted real estate spoliation targeting a public building located in the commune of Gombe.
In a statement issued on Wednesday, March 25, 2026, the Ministry of Justice announced that the Kinshasa/Gombe High Court has convicted 72 people involved in this case in connection with the ATF building, located at 14 Gombe Avenue.
According to judicial authorities, this decision follows a coordinated intervention between the Attorney General near the Court of Cassation and the ministries in charge of Justice as well as Urbanism and Habitat. This action allowed to put a stop to an attempted forcible execution judged illegal.
The statement precisely stated that the operation had been undertaken without a valid executory title and in violation of the procedures in force, on a relevant property of the State’s private domain.
In this case, a bailiff and six of his associates were sentenced to the heaviest sentences prescribed by law. Meanwhile, 65 other defendants have served two years of penal servitude, while ten juveniles have been deferred before competent juvenile courts.
The government took advantage of this case to reaffirm its determination to combat the phenomenon called “Folio”, a fraudulent system resting notably on fabrication of false judgments with the alleged complicity of certain paralegals.
Through this decision, the authorities intend to send a strong signal in favor of the protection of land and real estate heritage, public as well as private, and the fight against spoliation networks in the DRC.
